HomeMy WebLinkAboutRes 1994-09 Private Activity Bond Allocation Authority' ' ALASKA ENERGY AUTHORITY RESOLUTION NO. 1994-09 RESOLUTION OF THE ALASKA ENERGY AUTHORITY DIRECTING THE EXECUTIVE DIRECTOR TO REQUEST AN ALLOCATION OF THE STATE OF ALASKA PRIVATE ACTIVITY BOND VOLUME CAP FOR 1994 FOR CERTAIN PROJECTS AND DETERMINING RELATED MATTERS. WHEREAS, the Alaska Energy Authority (the "Authority") is authorized and empowered by the provisions of Chapter 83 of Title 44 of the Alaska Statutes to issue bonds for the purpose of providing funds to pay the costs of projects; and WHEREAS, the Authority intends to issue its bonds to finance certain projects as described in this Resolution; and WHEREAS, the bonds will be private activity bonds within the meaning of Section 142 of the Internal Revenue Code of 1986 (the "Code"); and WHEREAS, the bonds will require an allocation of the State of Alaska's private activity bond volume cap under Section 146 of the Code; NOW, THEREFORE, BE IT RESOLVED BY THE ALASKA ENERGY AUTHORITY AS FOLLOWS: Section 1. That the Executive Director is authorized and directed to take any steps necessary to request and obtain from the State Bond Committee an allocation of the State of Alaska's 1994 private activity bond volume cap as provided herein. Section 2. That the Executive Director is authorized and directed to determine the amount of 1994 private activity bond volume cap to request from the State Bond Committee by taking into account the principal amount of private activity bonds the Executive Director reasonably expects to be necessary to finance the following projects: PROJECT ESTIMATED AMOUNT (000,000) Black Bear Lake Hydroelectric Project $12 Goat Lake Hydroelectric Project 10 Unalaska Geothermal Project 135 Upper Chilkoot Lake Hydroelectric Project 14 together with any additional amounts for said projects and with such other projects in addition to those listed above as the Executive Director reasonably expects to be financed in whole or in part by the issuance of private activity bonds of the Authority. Section 3. That the Executive Director is authorized and directed to take any steps necessary to carry forward in accordance with the provisions of Section 146 of the Code any of the 1994 State of Alaska private activity bond volume cap that the Authority does not use during 1994.
