Mitigation Obligati
During the project application process, a mitigation plan was established for
the Bradley Lake Hydroelectric Project which became a condition of the
licensing. That mitigation plan involved efforts to alleviate the impacts to
fisheries, waterfowl and moose habitats.
Representatives of the Alaska Department of Fish and Game (ADF&G), the
U.S. Fish and Wildlife Service (USF&WS), the Homer Fish and Game
Advisory Board (Homer Advisory Board) and the Alaska Energy Authority
(AEA) agreed to a moose mitigation concept which included the purchase of
habitat lands and the establishment of an endowment to fund studies on
moose habitat and to plan and undertake enhancement or preservation of
moose habitat. AEA agreed to purchase habitat lands in the Fritz Creek area
off East End Road as well as fund an endowment.
Moose Habitat Purchases
Prior to 1993, AEA either purchased or agreed to purchase or lease 593
acres of land adjacent to Fritz Creek. All purchase parcels, except for one
belonging to an Alaska Native Allottee, have been acquired. The Bureau of
Indian Affairs recently approved the transfer of that parcel which should be
completed by May 31. Final lease documents are being negotiated with the
Alaska Department of Natural Resources. The habitat lands are identified on
the attached drawing and summary.
Endowment
AEA proposed an endowment of $50,000. The resource agencies, ADF&G
and the USF&WS, advocated an endowment of $100,000, but the local
Homer Advisory Board refuses to accept less than $150,000. All parties
must agree on an endowment amount to resolve the mitigation effort. AEA
has set aside $150,000 in the construction budget to fund the endowment.
A second item related to the endowment was the obligation to prepare
annual reports and make studies available. The conceptual agreement
contemplated that the endowment would annually receive up to $2,500 for
administrative expenses. Rather than being faced with an annual operating
budget request, AEA has discussed the possibility of making a lump sum
payment from construction funds in lieu of annual payments. The parties

involved are amenable to such an approach. The cost is approximately
$25,000.
Organizational S
Initially the endowment was proposed to operate in the form of a trust.
After the AEA transition, the proposed trust was reviewed by staff and
replaced with a non-profit corporation proposal. Because the proposed
activities for the endowment involve improving moose habitat, which may
include such activities as hydroaxing, controlled burn and other risky
methods to prepare suitable habitat, staff proposed establishment of a
corporation instead of a trust to insulate AEA and the project from those
risks. All parties have agreed to the corporation approach, subject to
approval by the Attorney General’s Office. Representatives from AEA, the
ADF&G, and the Homer Advisory Board will serve as corporate members and
officers.
