February 2020 IS-1 INITIAL STATEMENT (pursuant to 18 CFR § 4.61(b)) BEFORE THE FEDERAL ENERGY REGULATORY COMMISSION APPLICATION FOR LICENSE FOR A MINOR WATER POWER PROJECT (1) The Community of Elfin Cove Non Profit Corporation, DBA Elfin Cove Utility Commission (ECUC), applies to the Federal Energy Regulatory Commission for a license for the Crooked Creek and Jim’s Lake Hydroelectric Project (project), as described hereinafter. ECUC previously held a preliminary permit for this hydropower site under P-14514. February 2020 IS-2 the appropriation, diversion, and use of water for power purposes, and with respect to the right to engage in the business of developing, transmitting, and distributing power and in any other business necessary to accomplish the purposes of the license under the Federal Power Act, are presented in Table IS-1. Table IS-1 also lists approvals not required under the Federal Power Act, but which the Applicant will seek if such approvals are helpful for efficient and timely project development. It is the intent of the Applicant to continue to consult with permitting agencies and comply fully with applicable Federal and State statutory and regulatory requirements. Section 404 Permit U.S. Army Corps of Engineers Federal Clean Water Act, Rivers and Harbors Act Wetlands delineations completed, Submittal of application for Nationwide Permit #17 is pending. Cultural Resources Preservation Alaska State Historic Preservation Office AS 41.35 Cultural Resources Survey and Report completed, Section 106 consultation will be coordinated with FERC licensing process. Special Use Permit (SUP) U.S. Forest Service 36 CFR Chapter II SUP application submitted June 26, 2014. Will be processed after FERC license issued. Certificate of Public Convenience and Necessity (CPCN) to furnish electric service. Regulatory Commission of Alaska AS 42.05 ECUC holds CPCN #701, issued March 19, 2004. No further action required for this project. USFWS Bald Eagle Protection Act and Migratory Bird Treaty Act Consultation and compliance with resource protection laws.
