HomeMy WebLinkAbout2011 Fire Hall window GrantCITY OF SEWARD, ALASKA EECBG Window and Door Replacement SPECIAL CONDITIONS SECTION 100.01 GENERAL STATEMENT AND EXTENT OF WORK All proposed Work is located within the City of Seward, herein defined as the Owner, and is more particularly located as shown on the design plans. The Work included under this Contract consists of furnishing all labor, tools, equipment, materials, transportation, supervision, and other facilities necessary to successfully complete the Work set forth in the plans and specifications. It shall be the responsibility of the bidder to prepare his/her bid so that all materials and/or fittings shall harmoniously conform to the intent of the Contract Plans, Specifications, and Special Provisions. The scope of work includes furnishing and installing 17 (3X3).fitber@lass triple pane windows in the Fire Department (Materials: $5,700 plus $1000 exterior trim for a total of $6700); 5 (4X5) vinyl triple pane windows and 4 sealed doors in the Public Works Department Building (Materials: $4,570 plus $1,000 for exterior trim for a total of $5,570); 58 (3X5) triple pane windows for City Hall (Materials: $24,000 plus $2,320 for a total of $26,320). The labor for replacing the windows and doors will require Davis Bacon wages for the following: 1. 4 people 2. 405 hours total (approximately 2 weeks) 3. $80/hour 4. 8 hour days Totaling: $32,448 The Contractor awarded the Contract for this project and all subcontractors shall be required to obtain a City of Seward business license. Construction of this project shall be performed by a contractor who has been regularly engaged in the construction of municipal water and sewer utilities for a minimum of 3 years immediately prior to the award of this Work, and has installed not less than 1,500 feet of water or sewer piping within that time. SECTION 100.02 REFERENCE TO MUNICIPALITY OF ANCHORAGE STANDARD SPECIFICATIONS The Municipality of Anchorage Standard Specifications dated 2009, hereinafter referred to as MASS, are hereby referenced, incorporated in, and become a part of the contract documents for this Work. All references to the Municipality of Anchorage contained in MASS shall be changed to read the City of Seward. All references to the Anchorage Water & Wastewater Utility, hereinafter referred to as AWWU, shall be changed to read the City of Seward. All MASS references to work which will be performed by AWWU shall be disregarded; the Contractor is responsible for all work required to complete this Project. MASS is available for download on the Municipality of Anchorage website, at the following link: Page 1 EECBG Window and Door Replacement Special Condition http://www,muni.org/Departments/project management/Pages/MASS.aspx Also included as part of these Contract documents are the City of Seward General Conditions of the Construction Contract for Buildings, hereinafter referred to as General Conditions. In the event that there is a conflict between MASS and the General Conditions, the General Conditions shall govern. All Work under this Contract shall comply with the latest edition and addenda to all applicable codes, ordinances, and standards. It shall be the responsibility of the Bidder to prepare his/her bid so that all materials and/or different arrangements of connections or fittings harmoniously conform with the intent of the Contract Plans, General Conditions, MASS, and these Special Provisions. SECTION 100.03 TIME OF COMPLETION Refer to Division 10 Standard General Provisions, Section 10.05 Control of Work, Article 5.22 Time for Completion of Work. SECTION 100.04 MODIFICATIONS AND ADDITIONS TO MUNICIPALITY OF ANCHORAGE STANDARD SPECIFICATIONS The following listed provisions of MASS are amended as hereinafter stated: A. DIVISION 10 STANDARD GENERAL PROVISIONS Add the following Section: SECTION 10.00 ALL APPLICABLE MASS ARTICLES Delete any and all references to and requirements for compliance with Anchorage Municipal Code Chapter 7.60 the Disadvantaged/Women Owned Business (DBE/WBE) program and specifications. SECTION 10.01 DEFINITIONS Delete the first sentence and replace with the following: In these Contract Documents, the following words or expressions shall have the meaning given below: Add the following definitions: SECTION 10.04 SCOPE OF WORK Article 4.8 Work Incidental to the Contract Add the following items to the list: 16.Other items indicated on the drawings or in these specifications, but not specifically listed as a Bid Item in these Contract documents. Page 2 EECBG Window and Door Replacement Special Condition Article 4.13 Traffic Control Plan Add the following: The Contractor shall prepare and submit four copies of an acceptable Traffic Control Plan (TCP) to be employed during construction. The TCP shall be delivered to the Engineer within ten (10) working days of the effective date of the Notice -To -Proceed, or five (5) working days before commencement of Work, whichever is the earlier date. The Engineer will review and accept or reject the plan within five (5) working days of submission. Successive submittals will also be reviewed within five (5) working days. The review by the Engineer is separate from any other agency review. Article 4.17 Utilities Add the following to the end of the seventh paragraph: Utility locates are the responsibility of the Contractor to request, coordinate with the Work, maintain, and protect. Add the following New Article: New Article 4.22 Responsibility of Contractor to Act in Emergency In case of an emergency that threatens loss and / or injury of property, and / or safety of life, the Contractor shall act, without previous instructions from the Engineer, as the situation may warrant. The Contractor shall notify the Engineer thereof immediately thereafter. Any claim for compensation by the Contractor, together with substantiating documents in regard to expense, shall be submitted to the Owner through the Engineer and the amount of compensation shall be determined by agreement. The Contractor shall supply the Engineer, prior to commencement of Work, with an emergency telephone number through which a responsible Contractor's representative can be contacted on a twenty-four (24)-hour a day basis. SECTION 10.05 CONTROL OF WORK Article 5.4 Non -Working Hours, Holidays, Saturdays, and Sundays Add to the end of the last paragraph: A standard work day is a ten (10) hour work day (excluding meal times) within the time frame of no earlier than 7:00 AM and no later than 7:00 PM. Article 5.22 Time for Completion of Work Add the following after the first paragraph: All work under this Contract shall be substantially complete by August 22, 2010 based upon a Notice -to -Proceed date of May 24, 2010. All work under this Contract shall be complete by September 24, 2010. Article 5.27 Liquidated Damages Delete the first two sentences of the first paragraph and replace with the following: The Owner may deduct out of any progress payment the sum of Five Hundred Dollars ($500.00) per day as Liquidated Damages for each and every calendar day that the Page 3 EECBG Window and Door Replacement Special Condition Substantial Completion Date is delayed beyond the Contract Completion Date specified in Article 5.22, Time for Completion of Work. In addition, after substantial completion, the Owner may deduct out of any progress payment the sum of Two Hundred Fifty Dollars ($250.00) per day as Liquidated Damages for each and every calendar day that the Final Acceptance Date is delayed beyond the Contract Completion Date. SECTION 10.06 LEGAL RELATIONS AND RESPONSIBILITIES Article 6.6 Permits Add the following to the end of the sixth paragraph: The Contractor shall identify the "Anchorage Water and Wastewater Utility" as the applicant on any permit application forms. SECTION 10.07 MEASUREMENT AND PAYMENT Article 7.5 Progress Payments Insert the new numbered item six and renumber the remaining items seven through nine. 6. Failure to submit the detailed Schedule of Values consisting of several elements as required. (The Engineer cannot pay on any of the items specified to be broken down until the breakdown is received and accepted.) Add the following to the end of items listed in the fourth paragraph (Withholding): Monies withheld under Article 7.5 - Progress Payments, shall be paid to the Contractor by subsequent pay estimates that follow the date on which the Contractor satisfactorily corrects the deficiencies causing the withholding. Delete the fifth paragraph and replace with the following: The amount of any withholding for items one (1) through six (6) above shall be the reasonable value of the Work or remedy to be accomplished as estimated by the Engineer, without regard to bid amount of cost to the Contractor. The amount of withholding for items seven (7) through nine (9) shall be in accordance with the claimed amount or the applicable Contract provisions. Add the following after the last paragraph: The State of Alaska funds this Contract (in part); therefore, the provisions of Alaska Statute 36, Section 36.90, and Article 3 entitled "Public Construction Contract Payment' apply. The monthly pay estimate shall be computed on the basis of Work completed. All quantities shall be subject to review by the Engineer prior to approval for payment. Monthly price allocation for payment of Lump Sum items shall be based on the approved Construction Progress Schedule and Schedule of Values.
