Box 110024 Juneau, Alaska 99811-0024 Main: 907.465.4105 Fax: 907.465.4759 I reviewed the information you provided regarding the proposed hydroelectric facility on Crooked and Jim's Creeks, near Elfin Cove, AK. The project will remove water from Crooked Creek and divert it through a penstock to Jim's Lake where another penstock will convey water to a powerhouse near the mouth of Jim's Creek. According to data in the Catalog of Waters Important for the Spawning, Rearing, or Migration of Anadromous Fishes, the fisheries survey from Alaska Biological Consulting you provided, and ADF&G Sport and Commercial fisheries staff observations, there are no anadromous fish present in either drainage. The amount of water that you propose to withdraw from Crooked Creek does not present a threat to the small number of resident Dolly Varden char found near tide water about 2,000 feet downstream of the intake and several tributaries. A fish habitat permit from the Division of Habitat is not required for this project. Please be advised that this determination does not relieve you of the responsibility for securing other permits, state, federal or local and that you are still required to comply with all other applicable laws.
