(2) The location of the project is: State or territory: Alaska County (Borough): N/A. Alaska is divided by boroughs and recording districts. The project area is not located within a borough, but is within the Sitka Recording District. See 16 U.S.C. 796. (6)(i) The statutory or regulatory requirements of the State of Alaska in which the project would be located that affect the project as proposed with respect to bed and banks and the appropriation, diversion, and use of water for power purposes, and with respect to the right to engage in the business of developing, transmitting, and distributing power and in any other business necessary to accomplish the purposes of the license under the Federal Power Act, are presented in Table I-1. Table I-1 also lists approvals not required under the Federal Power Act, but which the Applicant will seek if such actions are helpful for efficient and timely project development. It is the intent of the Applicant to continue to consult with permitting agencies and comply fully with applicable statutory and regulatory requirements. Cultural Resources Preservation State Historic Preservation Office AS 41.35 Cultural Resources Report and determination of eligibility to be submitted to Alaska SHPO for review and comment (summer 2012). (ii) The steps which the applicant has taken or plans to take to comply with each of the laws cited above are:  A Water Rights permit application (#LAS283000) was submitted to the Alaska Department of Natural Resources in October 2011.  A Fish Habitat Permit will be obtained from the Alaska Department of Fish and Game for instream work. IPEC has consulted with ADF&G during development of the license application, and ADF&G has actively participated in agency meetings and site visits to review the project.  A Section 404 permit will be obtained from the U.S. Army Corps of Engineers to discharge of dredge or fill materials into waters of the U.S. and wetlands. Any necessary construction conditions or wetland mitigation requirements will be determined during the permitting process.  An evaluation of potential project affects on historical, archeological and cultural resources has been prepared. This evaluation will be submitted to the State Historic Preservation Office and potentially affected tribes for their review and comment on findings in the cultural resources report. (7) Brief project description (i) Proposed installed generating capacity 0.455 MW. (ii) Check appropriate box: existing dam  unconstructed dam existing dam, major modified project (8) No lands of the United States will be affected by the proposed project. (9) Construction of the project is planned to start within 24 months, and is planned to be completed within 48 months, from the date of issuance of license.
