Memorandum of Lease This Memorandum of Lease is intended to give notice of a COMPETITIVE GEOTHERMAL LEASE, Form #DOG 200805GL, issued October 31, 2008. Said Lease was issued by and between the State of Alaska, as Lessor, and Ormat Nevada, Inc., as Lessee, and is effective November 1, 2008, Pursuant to the terms of said Lease, the Lessor grants to the Lessee, without warranty, the exclusive right to drill for, extract, remove, clean, process, and dispose of oil, gas, and associated substances and the nonexclusive right to conduct geological and geophysical exploration for oil, gas, and associated substances and to install pipelines and build structures to find, produce, save, store, treat, process, transport, take care of, and market all oil, gas, and associated substances and to house and board employees in its operations until lease expiration on October 31, 2018, unless sooner terminated, on the lands described in the attached Exhibit A(s). The Lease also provides for the Lessee to maintain the lease for so long thereafter as Lessee is producing oil, gas or associated hydrocarbons in paying quantities therefrom, and on such other terms and conditions as set forth in the Lease. This Memorandum of Lease is prepared for the purpose of recordation as authorized under AS 40.17.120 and in no way changes, modifies or otherwise affects any provision of the Lease, including the mitigation measures incorporated therein.
