Subject: Withdrawal of Preliminary Permit Application, Dillingham Area
Hydropower Project (DAHP), FERC No. 13238-000.
Madame Secretary:
Nushagak Electric and Telephone Cooperative (NETC) respectfully withdraws the
Subject Application for Preliminary Permit (“Permit”). The Permit application, dated
June 6, 2008, was made concurrent with NETC’s request for Jurisdictional Determination
for the two DAHP components, the Lake Elva and Grant Lake Projects. By letters dated
August 4, the FERC Director declared the Projects non-jurisdictional under Federal
Power Act Section 23(b)(1), and stated that the Projects would not require licensing
(Dockets DI08-8-000 for Grant Lake; DI08-7-000 for Lake Elva). Accordingly, NETC
has decided not to seek a FERC license for the component Projects of the DAHP,
obviating the need for the Preliminary Permit and further FERC involvement in Project
licensing.
Please inform us of any further requirements which might accompany this withdrawal.
