Delta/Greely School District Board Policy 7420
Construction contracts in excess of ten thousand dollars ($10,000) shall be awarded
by a competitive bid procedure. Sealed bids shall be solicited by publication in
newspapers reasonably calculated to reach prospective bidders. Such publication
shall contain at least a general description of the item or work required and shall
designate the place where detailed requirements and specifications may be
obtained, and the time and place where the sealed bids will be opened publicly.
All bids shall be sealed, identified as bids on the envelope and must be submitted to
the Superintendent/Chief School Administrator or project supervisor at the time
and place specified in the public notice inviting bids. Bids shall be opened in public
by the Superintendent/Chief School Administrator or project supervisor at the time
and place designated in the bid notice. Bids received after the specified time shall
not be accepted and shall be returned unopened, to the bidder.
The Board, in making an award, shall take into consideration conformity with the
specifications, terms of delivery, and other conditions imposed in the call for bids
and by law. A bidder who has failed to satisfactorily perform on a previous contract
may be rejected.
The District further reserves the right to reject any and all bids when such rejection
is in the best interest of the District. The District shall have the right to waive
informalities and minor irregularities in a bid received, when such waiver is in the
best interest of the District
At the time bids have been received and opened, the Superintendent/Chief School
Administrator or project manager may return the bid bonds or deposits to all
bidders, except the three (3) finalists meeting specifications. All bid deposits and
bonds shall be returned to unsuccessful bidders after execution of the contract and
deposit of the required bonds by the successful bidder.
