HomeMy WebLinkAboutAttachment 4.3.2 Land OwershipSTATE OF ALASKA 3700 Airport Way Fairbanks,AK 99709 phone:907.451.2740 fax:907.451.2751 DIVISION OF MINING,LAND AND WATER Northern Regional Office The Delta/Greely School District (DGSD)has had legal authorization to use and develop the land the main high school and associated facilities are located on for a considerable time.The original school site was granted an Interagency Land Management Assignment (ILMA)under ADL 32814 on March 1,1974. As the originallLMA grant w~s being final,ized,more state-owned land was requested under ADL 62151, on August 8,1973 for an approximate 26 acre addition for further facilities. The adjudication process for the proposed addition took some time to accomplish,mostly due to the need for a survey,which was only recently completed.In the interim the Final Finding and Decision(which is the State's best interest finding,and is the 'final word'on an authorization)was accomplished on March 11,1991.This Decision amended the originallLMA request to include present day Tracts B &C of ASLS 2005-12,and to include the originallLMA (ADL 32814).Tracts A &D of ASLS 2005-12 were dropped from the original request so they could be conveyed to the City of Delta Junction for pUblic purposes.This Detision also constitutes the State's mechanism for conveying interest in the land to the DGSD (Department of Education through the 10caIREAA),and for issuing the finallLMA.I expect the ILMA to be issued shortly,once we receive and approve a current Development Plan. Since that time we have all waited on the appropriate survey to be accomplished for the site,which was finally finished in July of 2007.In the meantime our statute for Public and Charitable Sales has changed • (AS 38.05.810(a)),allowing an eligible entity like the DGSD to apply-for and own the land their public facility is located upon.It is the intention of the DGSD to request the ILMA (when issued)to be converted into a sale under the aforementioned statute,and to,therefore,own the property the school is located upon.This too would have necessitated a survey of the exact kind to be accomplished in order to adequately describe the property for conveyance to the DGSD.
