Command Structure MSDS Forms Schedule of Compliance FRP-Jan 2002 ACT Page -Iii Village of Newtok Facility Response Pian APPENDIX D FACILITY DEFICIENCIES Review of the facility has resulted in the discovery of many deficiencies.These deficiencies must be corrected to bring the facility into compliance with the EPA and USCG regulations.A discussion of the requirements of each deficiency follows: EPA 112.7 (e)(1)(iii and iv)requires that discharge from undiked areas be designed to flow into ponds,lagoons,or catchment basins to retain oil or return it to the facility.If design as above is not present,all ditches inside the facility must be equipped with a diversion system that would, in the event of an uncontrolled discharge,retain oil in the facility.The NTF does not have such systems. EPA 112.7 (e)(2)(ii)requires secondary containment large enough to contain the entire contents of the largest tank in the tank farm and sufficient freeboard to contain precipitation.The NTF does not have any secondary containment. EPA 112.7 (e)(2)(vi)requires that periodic integrity testing of tanks must be completed using hydrostatic testing,visual inspection,or non-destructive shell thickness testing.EPA clarifies that they recommend such techniques as radiographic,ultrasonic,or acoustic emissions testing for testing of aboveground tanks and do not believe that visual tests alone are sufficient.No such testing has ever been completed at the NTF. The integrity testing must include inspection of the tank foundations. Tank A-NC-5 is in danger of toppling due to its closeness to the bluff edge and continuing erosion of the bluff.This tank needs to be moved to a safer location with a better foundation.Other tanks that are leaning need to have their foundations repaired or replaced to correct the condition. EPA 112.7 (e)(3)(ii)requires that terminal connections that are capped or biank- flanged must be marked to their origin while not in service or in standby service for an extended time.Markings are not present on the terminal connections at the NTF. EPA 112.7 (e)(3)(iii)requires pipe supports be designed to minimize abrasion and corrosion and allow for expansion and contraction.The supports at the NTF do not meet this requirement and some of the piping is on the ground. FRP -Jan 2002 Page D-1 © Village of Newtok :Facility Response Plan EPA 112.7 (¢)(3)(iv)requires that all piping at the facility must have periodic pressure testing completed if no other methods of leak detection are in place.Currently no other methods are present.Therefore,the piping must be tested for leaks using nationally recognized methods for tightness testing.If the testing completed to comply with USCG 156.170 (f)(1)were to be completed as discussed below that tasting would comply with this EPA regulation. EPA 112.7 (e)(8)requires that inspections be completed and documented as outlined in the FRP.Such inspections should be maintained in the plan for three years.The written inspection program provided in this FRP must be implemented immediately. EPA 112.7 (e)(9)(i)and EPA CFR 120.20 (10)require that the facility must be fully fenced.The NTF has no fencing. EPA 112.7 (e)(9)(ii)requires that valves located on the bottom of tanks at the facility.be secured with locks to insure that non-authorized personnel cannot open them. EPA 112.7 (e)(9)(v),USCG 154.570 and 154.310 (20)requires that if operations were conducted at night,adequate lighting must be in place at each transfer connection point and at each operations work area.The NTF could petition to have portable lighting because of the small size of the facility if night operations are needed.Operations are currently conducted during the day only.If necessary,the portable fighting must be shielded. EPA 112.7 (e)(10)(1 and iii)and USCG 154.310 (21)requires that personnel should be property trained in the operation and maintenance of discharge prevention equipment and the applicable pollution control laws and regulations.Spill prevention briefings should be conducted to insure personnel understand the FRP.The training program must be implemented immediately. EPA 112.21 and USCG 154.310 (21)requires that facility response training and drills/exercises be completed.The training and logs included in the FRP must be immediately implemented.Training certifications must be obtained,periodically updated,and kept with the FRP training documents.The training program must be implemented immediately. EPA 112.20 (h)(3)(and ji)requires that personnel,equipment,and contractors necessary to remove the worst case discharge and other discharges to the maximum extent practicable be available.To accomplish this a minimum of 1,000 feet of containment boom is required for discharge at the facility.The NTF has no containment boom.The 160 feet of FRP -Jan 2002 Page D-2 Village of Newtok Facility Response Plan absorbent boom available to the NTF does not satisfy the requirementforcontainmentboom. EPA 112.20 (h)(6)(iv)requires that measures to provide adequate containmentanddrainageofdischargeoilbeinplace.The NTF does not have the needed containment to handle a worst case discharge,nor do they haveantdrainagecontrolfordischargedoil. USCG CFR Part 156.170 (f)(1)and 154.310 (16)requires that integrity tests for the piping needs to be available for review.The piping must be checked annually or 30 days prior to a delivery.This would apply to the piping if used to unload fuel from a vessel.As indicated in the FRP,the barge hose is used to unload into the tanks and this integrity testing requirement would apply only if the terminal piping were used to unload the fuel barge. USCG 154.735 (q and r)requires that electrical equipment installed after October 4,1990,meets NFPA 70 requirements and shows appropriate approval. Currently,there appears to be some concerns with the electrical components in the pump sheds,but the dates of the installations of electrical equipment are unknown.NTF operators should verify this requirement is met if necessary.. General Deficiencies:Other deficiencies that are not identified directly the spill response regulations,but that are have been identified as needed to Insure safe operation of the facility and implementation of discharge response,are identified below. The response equipment at the facility needs to be updated to have in inventory protective equipment for response personnel.The additional equipment to have on hand includes air cartridge respirators and protective clothing (Tyvek outer wear or similar,rubber boots,and rubber gloves),The NTF needs to also have at least one roll of 40 feet by 100 feet of 10 mil reinforced plastic liner,and hazmat bags to store contaminated absorbents and discarded protective clothing. Schedule Of Compliance The deficiencies identified above need to be addressed as soon as resources of the NTF allow.A schedule of compliance must be developed presenting timing when the deficiencies are to be addressed.The schedule of compliance should be placed with the FRP in the appropriately marked tabbed section. Ownership/Operation The tank farm is currently owned and operated by the Lower Yukon School District. 'Dike/Liner The tank farm had an wood dike covered with sheetmetal.The dike held fluid and an impermeable liner is reported to underlay the tank area. Tanks The tanks were single wall,welded steel construction and appeared to be field fabricated.The tanks did not have API 650 or UL 142 labeling.A wooden catwalk spans the tanks and a wooden ladder reaches from the ground elevation to the top of the tanks. The ladder was unaccessible at the time of the inspection and the top of the tanks were not examined.The tanks appeared structurally sound with only slightly noticeable surface corrosion at the welded seams.The tanks had normal venting caps and top manhole access ways.The tanks did not have level gauges nor emergency venting. Fill/Distribution A two inch threaded steel fill line from the beach serves the fuel tank holding facility.The fuel is distributed to the generator shed through a 1 -inch threaded pipe. Spills/Leaks No sign of major leaks or spills were detected. Combustible/Flammable Materials : Small dimension timber pedestals that serve as the tank foundations under the tanks,the wooden catwalk and the wooded ladder are all combustible materials. Dike/Liner A heavy timber dike wall surrounds the tank area.The timber was protected on the inside of the dike with sheet metal.There was no liner within the diked area. Tanks The tanks are single wall,welded steel construction,conical roofed BIA tanks without API 650 or UL 142 labeling.The tanks had normal venting capabilities,but lacked emergency ventilation capabilities.The tanks did not have level gauges. The vertical tanks were founded on 8”x 8”timber sleepers,decked with 2”x 6"lumber. The outside paint coating of all tanks was in fair condition. Fill/Distribution The tanks are filled through a 3-inch header pipe that initiates near the bank of the river.This pipe and the manifold system are comprised of victaulic fittings and joints.A 1-1/2 inch threaded steel pipe supplies fuel to the school's generator and boiler building approximately 20 feet away. Tuberculosis was a major health problem during this period.In the late 1950s,the village was relocated from Old Kealavik ten miles away to its present location to escape flooding.A school was built in 1958, although high school students were required to travel to Bethel,St.Mary's,Sitka or Anchorage for their education.This was often their first exposure to the outside,and students returned with a good knowledge of the English language and culture.A high school was constructed in Newtok in the 1980s. A City was incorporated in 1976,but it was dissolved on Jan.28,1997.Due to severe erosion,the village wants to relocate to a new site called Taqikcaq,approximately 5 miles away on Nelson Island. The land is part of the Yukon Delta National Wildlife Refuge,and villagers hope to exchange land with the U.S.Fish and Wildlife Service. Culture: Newtok is a traditional Yup'ik Eskimo village,with an active subsistence lifestyle.Relative isolation from outside influences has enabled the area to retain its traditions and customs;more so than other parts of Alaska.The sale or importation of alcohol is banned in the village. Economy: The school,clinic,village services,and commercial fishing provide employment.Subsistence activities and trapping supplement income.27 residents hold commercial fishing permits. Facilities: Water is pumped froma lake into a water treatment plant,then hauled from a storage tank.In winter, melted ice is used when water in the storage tank runs dry or freezes.Households are not plumbed,and honeybuckets are used.A washeteria is available.The health clinic uses flush/haul tanks and the schools have individual wells.Refuse collection is provided,and a new landfill has been completed,but DOT has determined that it is too close to the airport.The community wants to relocate and rebuild facilities on Nelson Island.A Master Plan is underway. Transportation: A State-owned 2,180'gravel airstrip provides chartered or private air access year-round;major improvements are under construction.A seaplane base is also available.Boats,skiffs and snowmachines are used for local transportation and subsistence activities.Winter trails are marked to Chevak (50 mi.), Tununak,Toksook Bay,Nightmute and Manaryarapiaq (33.8 mi.)Barges deliver cargo during the summer months. In addition,the existing fuel system information will be updated on the village layout plans for future ADEC use for site remediation. 6.Conceptual Design Report Development.Concurrent with the development of the Conceptual Design,LCMF will develop the Conceptual Design Report. Per our discussions,this proposal is to develop a stand-alone CDR for bulk fuel upgrades,including proposed conceptual design upgrades for the Power Plant being developed by LCMF for the Alaska Energy Authority under a separate NTP. The CDR will be developed in accordance with the Rural Energy Group,Bulk Fuel Upgrade Program &Rural Power System Upgrade Program Project Reference Manual.The CDR is to include all major fuel users in the community and as directed by AEA. LCMF proposes to provide the following scope of work to AEA to complete this project: SCOPE OF WORK: Phase I -Conceptual Design Report Development Upon receipt of a Notice to Proceed,LCMF will: 1.Site Research.LCMF will gather existing community information to create a village layout map that will be used for site selection.Some of this work has beenArchitecturepreviouslycompletedforthePowerPlantCDRandwillbeincorporatedinthisEngineeringnewmap. Voice (907)273-1830 Fax (907)273-1831 P.O.Box 955 Barrow,AK 99723 Voice (907)852-8212 Fax (907)852-8213 Alaska Energy Authority May 2,2003 Page 2 3.Site Control Evaluation.LCMF will work with Rick Elliot to establish site control for the selected tank farm site and pipeline Right-of-Ways.Rick Elliot will evaluate the project site and develop a Site Control Opinion for inclusion in the CDR. 4.Geotechnical Investigation.LCMF will work with Duane Miller and Associates to perform a geotechnical investigation.Preliminary information has been gathered for the Power Plant CDR;however,additional field information may be required.For this reason,a field drilling operation is anticipated to complete the geotechnical investigation and provide foundation design requirements. 5.Conceptual Design Development.Using the information gathered from the community,LCMF will develop a conceptual design based on the input from AEA. The Conceptual Design drawings will include a project layout plan which identifies the tank farm site and pipeline routes,a site plan for each tank farm which shows tank and manifold piping layouts,and proposed tank farm foundations and dike details.The facility layouts and design details will be in accordance with the State of Alaska Fire and Life Safety regulations,including the adoption of the Uniform Fire Code and the Memorandum of Agreement between AFA and the State Fire Marshal office. In addition,the existing fuel system information will be updated on the village layout plans for future ADEC use for site remediation. 6.Conceptual Design Report Development.Concurrent with the development of the Conceptual Design,LCMF will develop the Conceptual Design Report. The CDR will be a summary of all of the existing information gathered above, including,at a minimum,the following: +Anexecutive summary; *Narrative identifying the communities current facilities and usage (each facility's storage capacities will be summarized in tabular form); ¢Identification of foreseen growth,or changes,in the community which will affect the amount of storage capacity required in the community; «Identification of applicable codes for the design of new and upgraded facilities; -Identification of locally available fill materials (if available),including estimated cost and ownership; ¢A discussion of the alternatives available,and benefits and costs for each; «Site Control Opinion; +Conceptual Design Drawings including a village layout plan,site plans for each alternative site,and typical pad/containment dike details.The available site survey information will be incorporated into the site plans; Alaska Energy Authority May 2,2003 Page 3 «Identification of permits required for construction; *Project Schedule which includes design,permitting and construction; ¢Budget Construction Cost Estimate based on force account work and historic costs for AEA construction projects; ¢Identify local labor pool if data is available from existing local entities,such as the Village Corporation,IRA Council,etc.; ¢Identification of types of locally available equipment for use on the project (identify rental rates if available); Three draft copies of the CDR will be delivered to AEA for review and comment prior to delivering one loose original and ten bound copies of the final report.In addition,AutoCAD drawing files will be delivered to AEA for all drawings included in the report. SCHEDULE We understand that this project is anticipated to be a 2004,or later,construction schedule;therefore,the CDR must be completed this summer to allow for time to design the upgrade and procure materials prior to the spring shipping season in 2004. Met with Larry Charles (Native Corp.Pres.) -Provided Mr.Charles w/2002 aerial photos of Newtok -He asked us to attend Traditional Council meeting at 2:00 pm to present current progress with power plant and bfu e Inspected Native Corp tank farms and power plant tanks (all tanks and equipment old and should be replaced) -3 horizontal tanks are on skids (no foundation)with dispensing at the end of each tank -no containment;2 tanks gas,1 tank fuel oil;told that this fuel is for the Native corp retail store. -3 vertical tanks are on flat plywood decking over cribbed beams with 3” pipe leading to capped fill/dispensing port (gravity)for both fuel types - no containment -very close to edge of high ground;2 tanks gasoline,1 tank fuel oil. -5 vertical tanks are on 2 x 12 's over liner.Containment liner is shot and dike has settled past any containment potential.3 tanks are power plant fuel oil and piped to fill/dispensing hut through 3”line w/victolic connections.2 tanks are Native corp (fuel oil?)and piped to other Native Corp vertical tanks through 3”line.Tanks have liquid level gauges. e Inspected power plant -Building is an old,wooden structure on post and pad foundation - unfenced,unlocked,with oil stains throughout flooring. -Uses day tank -elevated -filled from 55 gallons drums which are filled and transported from tank farm daily. -Waste heat to adjacent washeteria -used for warming water in tank. -3 generators -Magnetek 98 kW (check w/EPS as CDR calls out 122.5 kW)w/57980 hrs,Newage 125 kW w/61,398 hrs and Cat 125 kW w/26,573 hrs. e Inspected proposed new power plant site -Weather station smack dab in the middle of the site -Spoke with power plant operator and Paul Charles who indicated that the weather station was put in by YKHC preceding a new health clinic (ie he is under the impression that a new health clinic is going in at the site instead of a new power plant). -Told that weather station is a one year duration,then gone. e Inspected Ninglick River barge offloading pad and erosion effects Using common landmarks from 2002 photos and today,established that erosion from 7/4/2002 to 6/10/2003 is approximately 70 ft.(measurements taken at barge offloading pad. Wave action undercutting tundra mat. Should be no problem to bring barge offloading pipeline and marine header into bulk fuel facility. e Looked at potential sites for tank farm Site 1 (between school and old clinic -pics 229 &230 -low area in the middle/next to school/good access for marine header/good access to power plant &school/may have to use area on west side of boardwalk/talk to TC and NC regarding ownership and usability of old clinic site). Site 2 (north of United Utilities satalite building -pics 231 &232 - mixed low and high ground not very usable/BIA USS 4042 Lot 1 may foul up usability/area south and east of boardwalk more usable but inside BIA boundary/fair access to power plant and school).Supplemental -spoke w/Stanley Tom who says that BIA will pass ownership of Lot 1 USS 4042 to TC by end of August,2003. Site 3 (north of sewage lagoon -pics 233m 234 &235 -would have to move common fish drying area/mixed low and high ground not very usable/lots of area/good access to Ninglick marine header from east or west/good access to power plant and school). Site 4 (north of store/Native corp building -pic 242 -nice flat ground/must have barge access on slough/poor access to school and power plant) e Meeting w/Traditional Council Formal meeting with agenda and interpreter. Lenny opened by relating a brief history of the project. Lenny informed the council that money had been obtained to acquire power plant building,which had been done. The council was asked about the site -was it in fact promised to YKHC for a clinic -answer was yes,but confusion about the location of the site - Larry Charles said he would provide a survey showing that the clinic site is the same as the proposed power plant site (Mr.Charles did provide this after the meeting and it is on the same site). Assuming the proposed site is no more,Lenny asked for contact names and numbers so we can work quickly to pick another site -he indicated that,if another site is decided upon in the next couple of weeks,we may be able to mobe in material and equipment this fall to begin construction this winter -the contact names were Larry Charles,NC;Paul Charles, NC;and Stanley Tom,TC.I said that I would leave aerial photos and business cards for them and that way we can all be looking at the same thing when speaking by phone. Lenny was asked about timing for a new tank farm -he indicated that the tank farm study has just begun and was not as ready to move forward with;that it would take a very substantial effort by the village if it is to move forward with the power plant. I spoke about the silting of the Kayalivik River and asked for thoughts on barge access.The response was that it would not last forever. (Supplemental -looked at river at low tide after meeting and am convinced that we should not design to use for barge access as the river is almost completely silted in). Lenny suggested that we would have time to look at alternative sights for the power plant after the meeting and it was stated that the elders should go with us. After the meeting,Lenny,Jim and I waited outside and spoke to Larry & Paul Charles for about 10 minutes (but no elders,or anyone else,elected to go with us to look for alternative sites).I was asked if it would be feasible to site the tank farm on the east side of the Kayalivik River -I replied that it is feasible but not very practical;all viable options will be considered. Note:Stanley Tom was not at the meeting and,therefore,I was not provided with consumption rates that he was supposed to provide. e Inspect School tanks and generator building e Other 2 vertical tanks on plywood platform over cribbed wood foundation - metal containment wall which is deteriorating (did not inspect floor of tank farm for liner). Over the past years,the community has changed.All of the homes now own electric heaters,freezers,refrigerators,washers and dryers and home entertainment have increased.This year four more buildings have been constructed requiring even more electricty.The generators are exceeding their requirement capacity and once new buildings are in use we're concerned they will not last a year. Because of the poor condition of the generators,they are burning more fuel.Last year, one of the generators had mechanical problem and a mechanic had to be hired from Anchorage.The wires in the community are deteriorating badly and need repair.Because of these circumstances,the electric bills have increased dramatically.Some of the residents without jobs are behind in their payment that affecting the Ungursaq Power Company financially. We urge the commission to reconsider providing a bigger,powerful generator enough to last us until the relocation is in affect and save us and the Ungursaq Power Company thousands of dollars. Unfortunately,AEA's ability to proceed with development of these projects has been adversely affected by local conditions related to the erosion problems that Newtok experiences and the community's plans to relocate in the near future.These conditions are at odds with the Denali Commission's Investment Policy.As a result,AEA has no plans to proceed with the tank farm and powerhouse projects at this time.
