As a Federally recognized American Indian tribe,MIC maintains a government-to-government relationship with the United States,and the United States holds a fiduciary obligation to protect the lands and resources held in trust for MIC's benefit.As the division of the Federal government responsible for maintaining responsibilities under Federal-Tribal trust,MIC finds it necessary to submit this petition to the Northwest Region,Bureau of Indian Affairs (BIA)and Assistant Secretary-indian Affairs (AS-IA)for their immediate assistance in accessing federal assistance for the purchase and overhaul of the diesel generation systems that serve as MIC's primary power delivery,and other needed technical and logistical assistance,pursuant to Resolution #18-44'andResolution#18-452. Due to atypical weather patterns and gross resource mismanagement,MIC has been undergoing a sustained threat to the resource supply that historically provides water and energy to the community.The Council had several years of substantiated proof that confirmed overall gross mismanagement contributed to the severity of the threat.The Council has the inherent authority 1 Resolution 18-44 2 Resolution 18-45 to protect the public health,safety and welfare of the residents of the AIR.This includes the responsibility to undertake measures to prepare and manage emergencies.The Council took formal action to dissolve the board responsible for complete utility oversight,and concurrent action resulting in immediate termination of the general manager of Metlakatla Power and Light (MPL),on April 16,2018,due to lack of transparency,communication,and gross resource mismanagement. The Council made this decision based on defendable and measurable confirmation that the immediate threat to the AIR water and energy supply and delivery systems was directly associated to the gross mismanagement of the utility by the general manager;and lack of accountability of the utility board to Council. Following dissolution of MPL,the Council now has a complete understanding of the mechanical and financial health of the utility.During the months since assuming the utility,the Council has been presented with overwhelming evidence of gross financial and resource mismanagement by the general manager.At the point the Council assumed acting authority and oversight responsibilities,MPL was severely insolvent and in extreme arrears.To be clear,mismanagement occurred under the oversight of a board distinctly separate from the Council.The board members and Chairman,who concurrently served as the Superintendent of the Metlakatla Agency,BIA, were publicly elected.Consequently,the members,under the guidance of the Chairman who was elected to serve as the highest officer of the board,and also having a separate and specific responsibility to serve as the direct Federal representative to the Tribe,agreed to absolute responsibility and authority in the oversight of those delegated to manage the day-to-day functions of the utility. At the point the Council assumed acting authority of oversight,MPL was severely insolvent and in extreme arrears.The integrity of the mechanical equipment that delivers the secondary power supply is unreliable,and the primary backup is completely compromised due to complete mechanical failure that occurred on Wednesday,August 16,2017 at 6:00 a.m.,Alaska Standard Time.It is anticipated that the failure of the system will put much pressure on an already vulnerable and barely operable secondary system of delivery*.The system is not sophisticated enough to isolate zones,or properly shed load to relieve pressure on the generator that the community is currently depending on. We have exhausted every resource available to us at this point.Without immediate financial and technical assistance,the likely result will be complete failure to the power delivery system and subsequent long-term power outage,which will consequently result in a complete catastrophic event.Again,|want to clearly communicate to the BIA that,the catastrophic event that is being described,is not merely an interruption of power delivery,but a long-term power outage that will affect the safety of our members',residences,businesses and the Tribe's fish-packing plant, which is the sole industry and source of economic revenue for AIR. 3 Metlakatla Power &Light System Definition This formal request comes with the unequivocal understanding and unanimous agreement of the Council,operations staff of MPL,and supporting federal and private technical experts the situation is critical and directly impacts the health,safety,and welfare of the members of MIC and residents of AIR.In an effort to circumvent the impending catastrophe,the Council and Executives are without any alternative solution but to request your immediate assistance.As the leader of the Tribe,|ask that the BIA please consider your role and obligation in ensuring that the United States fulfill its obligation to Federally recognized Tribes,under the Constitution,agreements,and regulations of the United States. Purple Lake =3 x 1000kW Francis turbines -MPL has only been operating one unit at around 800kW due to low lake levels Chester Lake =1 x 1032kW Pelton turbine -has been operating at about 200kW due to low lake levels Diesel #1 =1 x 4000kW Cat generator with -currently operating at about 1000kW.Due to multiple previous mechanical failures,it is unknown how much or how long it can support the remainder of the community's load. The Metlakatla Indian Community relies on limited hydro-generation (one 1 MW Pelton turbine and three 2 MW Francis turbines)and one XQ 2000 CAT and one 5000 kVA CAT (called the "older generator,”dating from 1986).At 6 AM,August 16,2018,the smaller CAT experienced a mechanical failure.This generator was purchased as a back up to our older generator,which has outlived its life expectancy.We are in the impact phase of this sustained threat to local energy and water delivery and supply.Since this threat,MIC has been forced to rely on diesel generation as the primary energy source to deliver energy to residents,community buildings,and our sole source of industry due to the impacts of changing weather conditions,resulting in our inability to rely on hydropower as the historical primary source of energy.Therefore,we are at a critical state concerning our water for hydropower,due to low lake levels,which are the direct result of an extended drought in the region. 1 BIA Diesel Justification letter dated 7-30-18;Request for New Generator letter dated 6-22-18; Emergency Funding Request letter 4-26-18;BIA Fuel Request 6-22-18;Emergency Declaration -Water and Energy Crisis-6-11-18 As a direct result of the mechanical failure of the XQ 2000,the Metlakatla Indian Community declared a state of emergency with regard to our energy and water crisis'. The mechanical failure of the XQ 2000 means that we are now without reliable backup diesel generation and on the verge of a catastrophic outage,thus threatening the life,health and safety of every MIC member and resident.The Community is now relying upon the older generator as the primary energy source,for the foreseeable future,until repairs can be identified and then performed upon the XQ 2000.The vulnerability this places the community in cannot be overemphasized. The older generator experienced nearly catastrophic failure last year,as detailed in our previous reports,letters and supporting descriptions.This included a site visit by a delegation which included Ms.Tammie Poitra,Acting Northwest Regional Director,BIA;Mr.Bodie Shaw, Northwest Deputy Regional Director of Trust Services,BIA;Mr.Milo Booth,Senior Advisor to the Director of the BIA;Ms.Jeannie Hoveland,Senior Advisor to the Assistant Secretary of Indian Affairs;Tyler Fish,Counselor to the Assistant Secretary of Indian Affairs,Mr.Stephen Manydeeds,Division Chief of the Division of Energy and Mineral Development (DEMD),and Jennifer Reimann,Civil Engineer,DEMD.The delegation was able to observe the condition of the facility and equipment,and the imminent necessity to replace the older generator. Based on these circumstances,the Metlakatla Indian Community,is requesting financial assistance to purchase a new diesel generator to provide primary energy generation due to current lake levels*®and to perform as supplemental power during periods when the lakes are in good condition,and/or until additional energy resources can be integrated into the system.See attached quote. MIC remains in a crisis status,until this situation is resolved.MIC has been enforcing strong conservation throughout all of the community,restricting both water and energy use to the strongest extent possible.The community entities such as the Leask Market grocery store and Silver Bay Seafoods-Metlakatla fish processing plant have put measures in place to restrict unnecessary use of the freshwater resources,and turning off all equipment when unused'. We are in the middle of a drought and the emergency we told you was coming,is now upon us.As we explained to you during your last visit to Metlakatla in June,our hottest and driest months are July and August.This is the time when we are the most vulnerable not only to outbreaks of fire,but to interruptions in service for water and electricity due to low lake levels resulting from lack of precipitation.As of 7/30/18,Chester Lake Reservoir is at 13.34 feet or 160.08 inches from the crest of the dam to the surface of the water.Which means we are only days away from having to cease hydro- electric generation at this source in order to preserve the remaining volume for municipal use and drinking water.Even this action may not be enough for Chester Lake to provide adequate municipal use and drinking water for the entire community should this heatwave persist,as extreme low water levels could threaten the integrity of the siphon within the penstock,which could cause interruption of services at the Water Treatment Plant.This has already happened in 2016,when fake levels fell to the point we are inches away from now.Under these severe conditions,we are forced to rely more heavily on diesel to make up the difference.We have less than 13 days (based on a 1500 gallon/day use)of diese!fuel in the tanks,and insufficient unrestricted cash on hand to purchase much more than two weeks'worth at a time.In the coming days,we will face the decision of whether or not to shut down our fish processing plant to conserve both water and electricity.This would have a devastating impact on our economy,because as you know,our community has always been dependent on fisheries,both harvesting and processing. Here is a summary of financial benefits of emergency funding for bulk fuel: e immediately upon receipt of funds,MP&L will start to see cost savings from lower administrative,operational,and transportation costs due to larger quantities of fuel being ordered at a time; e MP&L will also start to see immediate efficiency gains in generation by being able to run the generators at an increased load as recommended by engineers from the Division of Energy & Mineral Development and the CAT generator manufacturer; e MP&L will be able to increase the amount of fuel inventory on hand which will prevent any potential outages that could be caused by unforeseen issues in the supply chain of diesel fuel; e MP&L will be able to secure better payment terms with vendors which will allow MP&L to keep more cash on hand,having cash on hand is imperative to ensure MP&L is able to respond to any unforeseen disasters; e Without emergency support from the BIA for bulk diesel fuel,neither MIC nor MP&L will ever be ina fiscal position to pay down the existing liabilities of the utility,which is the essential first step in restructuring MP&L into a sound,sustainable Tribal Utility Authority. In short,buying in bulk will make the best use of the emergency funds. We have sent several emergency requests to you and the Northwest Region over the last three months. MIC is unable to fund the purchase of a new diesel generator due to financial health of MPL which is the result of mismanagement of resources,questionable financial management of MPL, lack of general oversight from the board,and lack of transparency.To resolve this,the Council took formal action to dissolve the Tribal utility oversight board and terminate the general manager on April 15,2018.The Council is currently acting as the interim utility board and has contracted with an outside consulting firm,Baker Tilly Virchow Krause,LLP ("Baker Tilly')to provide interim staffing (financial manager)and to perform a forensic financial investigation.The preliminary findings of this investigation revealed that the utility is insolvent,owing more than $800,000 in outstanding debts,including back taxes.MIC is currently in a crisis situation in regards to generation capacity,energy supply and financial standing,creating a situation where they may not have capacity to generate the power needs of the community. Chester Lake Penstock Extension Project:a collaboration between MIC and DEMD to ircrease the length of the penstock from the base of the dam out into the deeper reservoir, ir creasing access to the lake's storage capacity.The Penstock Extension project goes a other 18 feet into the lake.The main purpose of the Penstock Extension is to preserve the community's municipal water supply,while allowing use of the Chester Lake Hydro up to a point.The cost of the Penstock Extension was $250,000 in cash and grants and another $200,000 or more of in-kind effort from MIC staff and equipment. Rete increase from 9 cents/kWh to 11.5 cents/kWh in response to the financial crisis placed upon Metlakatla Power &Light (MPL)due to increased fuel use to meet energy demand. Council authorized $500,000+payment to MPL to cover Annette Island Packing Company debt to MPL which helped fund the purchase of the 2 MW diesel generator,repair the old SMW CAT diesel generator,and re-amortize the old RUS loan. Ac plied for a grant to conduct a feasibility study of the purple lake turbines to ensure efficiency out at the Purple Lake Hydro facility.This grant was awarded in 2015 and the work wis conducted in 2016 providing some recommendations for efficiency improvements. MI°L and MIC staff hiking up to each lake twice a week to take photos and measurements of the lake levels,that information is to inform the utility and the tribe on the level of conservation necessary and to modify use of utility resources.This has resulted in three years'worth of data on the lakes including how volatile Chester is to both weather and usage. SBS-Metlakatla LLC is a joint venture,and due to the fact that diesel use was going to be necessary for energy generation,the Task Force made sure that SBS-Metlakatla was able to include increased energy costs in the forecasted budget.This resulted in more energy ef iciency effort from SBS-Metlakatla in order to reduce costs and increase the profit margin. This is a critical effort,as the fish plant is one of the primary economic drivers in Metlakatla. $BS-Metlakatla LLC has been extremely responsive to water and energy conservation ef'orts and continues to be an engaged partner. The new information forced MIC to hire Baker Tilly to step in as interim administrators to maintain solvency and perform forensic audit.This is a $75,000 contract. MIC applied for emergency grant funds to DOI/DEMD to develop a bona fide Tribal Utility At thority,including a new rate study based on sound data.This effort is ongoing. Council approved the transfer of $100,000 from MIC Emergency Account to MPL account to cover immediate costs such as payroll and fuel. Urider new management MPL is updating past due accounts and making payment arangements or court orders for repayment. MIC worked with BIA Safety of Dams to conduct an assessment of the Chester Lake Dam, its classification has been upgraded from low hazard to high hazard,and the need for an eérly warning system was recognized and will be installed in July 2018,along with a ccmprehensive dam assessment to determine structural integrity of the Chester Lake Dam. Ttie Early Warning System will consist of a rain/precipitation gauge,and a sensor that provides low,medium and high water sensors via line of sight data to a central location in Matlakatla.This will allow MPL and MIC to make better informed operational decisions regarding operations of the Chester Lake Dam and Hydro. Council authorized Planning Committee to work with DEMD to create a Project Development Review Process and a Zoning Map to ensure that,once adopted,new development within MIC will be energy efficient. July 25,2018,community-wide town hall meeting to provide update on MP&L and give members an opportunity to ask questions and voice concerns.TUA fact sheet handouts were provided to educate the general public and MP&L consumers about how we got here aiid where we are going. MP&L includes copy of TUA fact sheet in all August 2018 billings to over 600 consumers. NIC Planning Committee is working hard to evaluate all of the policies and procedures to restructure their Tribal Utility Authority,and as of August 16,2018 the Planning Committee went through each of these items and will be identifying a board and adopting policies with a gal date to be completed by January 2019,including correct policy and oversight is in p'ace,a qualified general has been identified and hired,to ensure that the utility can be 0 erated in responsible manner with full transparency and fiscal management from this point forward. Funded by National Center for Atmospheric Research (NCAR).MHS Physics Class students ac>ompanied and observed and will be part of the Data-Collection Team. 45.September 25,2018 Town Hall Meeting Update on MP&L. 46.Organizing fourth Sustainability Expo scheduled for October 2018 in partnership with students of Annette Island School District (AISD)to educate about and encourage community-wide water and energy conservation,with door prizes. Impacts/Results from those steps: 1.Increased conservation in the home has reduced costs to homeowners.The outreach has impacted the students,senior citizens and all members of the community. 2.Using diesel in conjunction with hydro results in a diesel surcharge to the community members 3.The diesel surcharge creates a financial hardship on community members,with the surcharge frequently being as much as one half on top of the utility bill. 4.This coupled with the rate increase has resulted in a larger than usual nonpayment of bills. 5.Turning off half of the streetlights resulted in several slips and falls as well as increased theft in some areas where the darkness embolden would be thieves. 6.The Emergency Preparedness Response Plan and the Emergency Preparedness Task Force have been an invaluable communication and outreach mechanism,with their efforts and support,weekly and even bi-weekly lake level measurements have been acquired and shared with the group,and via them community outreach statements and communication have been generated.The group spearheaded the creation of the water and energy level indicators as a means to share with the community the level effort required in their conservation efforts,as well keep them informed about the potential of an energy outage or water shortage.The signs are updated weekly and represent the volatile nature of Chester Lake and the slower response of Purple Lake.The Task Force also has brought together stakeholders from the community who would be directly impacted in the case of an outage as well as helped define various response strategies. The Task Force encouraged the installation of the backup generators at AISD,asked them to consider installing diesel boilers instead of electric and to use diesel boilers during low lake level periods in order to reduce the overall demand on the generation system.The Task Force requested that the Lepquinum Wellness Center delay filling the pool until Chester Lake was in a position to support such an action without endangering the water reserves for the community.in addition,the application for funds to perform a EMERGENCY DECLARATION:WATER/ENERGY CRISIS SUMMARY 2018 water resources evaluation,to have the BIA SOD conduct a hazard analysis of the Chester Lake Dam,resulting in an elevation of the dam from low hazard to high hazard. 7.With support from the Task Force,the SBS-Metlakatla was able to work to perform all of the tasks to increase the energy and water efficiency of the fish plant,apply increased costs in the prospective budget to operate efficiently despite increased costs.The Task Force supported the community outreach efforts,the creation of the sustainability. 8.The Annette Island Service Unit Director,Rachael Askren,has invited Genelle Winter, Climate &Energy Grant Coordinator to speak to staff,updating them regularly on the status of the water and energy situation,bringing them up to date with current conservation efforts,grant proposals and outreach efforts. 9.The Division of Energy and Mineral Development has provided four (4)years of technical support,endless hours of effort,three (3)EMDP grants to improve the Intertie Proposed Project,Analyze the possibility of a Water Bottling Facility,and study the Efficiency of the Purple Lake Turbines,and most recently $250,000 to complete the development of the Tribal Utility Authority. At the:point the Council assumed acting authority of oversight,MPL was severely insolvent and in extreme arrears.The integrity of the mechanical equipment that delivers the secondary power supply is unreliable,and the primary backup is completely compromised due to complete mechanical failure that occurred on Wednesday,August 16,2017 at 6:00 a.m.It is anticipated that tlie failure of the system will put pressure on an already vulnerable and barely operable secondary system of delivery.The system is not sophisticated enough to isolate zones,or properly shed load to relieve pressure on the generator that the community is currently depeliding on. The Community relies on limited hydro-generation (one 1 MW Pelton turbine and three 2 MW Francis turbines)and one XQ 2000 CAT and one 5000 kVA CAT.The generator that expelienced mechanical failure was purchased as a back-up to the much older 5000 kVA CAT, which has outlived its life expectancy.We are in the impact phase of this sustained threat to local energy and water delivery and supply.As a direct result of the mechanical failure of the XQ 2000 the Metlakatla Indian Community declared a state of emergency with regard to our energy and water crisis.The mechanical failure of the XQ 2000 means that we are now without reliable backup diesel generation and on the verge of a catastrophic outage,thus threatening the life, healtli and safety of every MIC member and resident.The Community is now relying upon the 5000 kVA as the primary energy source,for the foreseeable future,until repairs can be ident fied and then performed upon the XQ 2000.The vulnerability this places the community in cannot be overemphasized. We have exhausted every resource available to us at this point.Without immediate financial and techriical assistance,the likely result will be complete failure to the power delivery system and subsequent long-term power outage,which will consequently result in a complete catastrophic even:.Again,|want to clearly communicate to the State of Alaska that the catastrophic event that is being described is not merely an interruption of power delivery,but a long-term power outacje that will affect the safety of our members,residences,businesses and the Tribe's fish- pack ng plant,which is the sole industry and source of economic revenue for AIR. This formal request is sent in conjunction to the declaration of a state of emergency and comes with te unequivocal understanding and unanimous agreement of the Council,operations staff of MFL,and supporting federal and private technical experts,the situation is critical and directly impacts the health,safety,and welfare of the members of MIC and residents of AIR.In an effort to circumvent the impending catastrophe,the Council and Executives are without any alternative solution but to request your immediate assistance. April 16,2018:MIC learns that MP&L has insufficient funds to make payroll,so the Council votes to transfer $100,000 from the MIC Emergency Account into the MP&L Payroll Account. April 26,2018:MP&L is discovered to be insolvent due to: e Insufficient cash-on-hand and zero cash reserves; e MP&L owed almost $900,000in outstanding debt:o Unpaid federal taxes, o unpaid employee retirement,o Unpaidinsurance,o unpaid diesel fuel bills,©unpaid travel bills,and more;e Rural Utility Service (RUS)loan on the verge of default,which,if in -default,would jeopardize the Community'S ability to apply forfutureloansorfederalgrants;e MP&L was owed over $400,000in outstanding receivables; e Our lake resources were drained to dangerously low levels and there was less than 10 days'worth of diesel fuelin the tanks.; The Danger:The utility was mere days away from closing,which threatens the health.safetv and welfare of the estimated 1,500 residents, 717 homes and 271 commercial/industrial customers,including the vital fish processing plant,the medical clinic,and the livelihoods of every.. single man,woman,and child living within the Annette Islands Reserve.* WHERE WE'RE GOING: >MIC explored the possibility of finding loan financing to consolidate MP&L's debts and to complete the intertie.However,without a functioning,solvent utility,we did not meet the eligibility loan requirements of any bank or government agency. The Mayor and Council have sent emergency letters of request to the Bureau of Indian Affairs (BIA),the Division of Energy and Minerals Development (DEMD),and U.S.Senator Lisa Murkowski to assist with bulk fuel,debt relief,completing the Metlakatla- Ketchikan Intertie,and purchasing a new diesel generator.MIC isreachingouttootheragenciesforassistance. MIC applied for and received a Tribal Energy Development Capacity Grant (TEDC)in the amount of $250,000iin order to restructureMP&L into a Tribal Utility Authority (TUA)whichis sound,solvent, stable and sustainable.During this project,Baker Tilly and DEMD will assist us to reorganize MP&L to operate under best public power utility practices in a transparent,accountable and sustainable fashion for the long term economic benefit of MIC while maintaining reliable service to MIC residents and businesses ata reasonable cost.
