CALL TO ORDER Chairman Brian Hickey called the telephonic meeting of the Intertie Management Committee to order on September 21, 2018 at 9:00 a.m. 2. AGENDA APPROVAL MOTION: Mr. Johnston made a motion to approve the agenda. Motion was seconded by Mr. Warren. The motion passed unanimously. 5. PUBLIC COMMENTS None 6. APPROVAL OF PRIOR MINUTES – August 17, 2018 MOTION: Mr. Borgeson made a motion to approve the minutes of August 17. Motion was seconded by Mr. Johnston. The motion passed unanimously. 7. NEW BUSINESS A. Teeland to Hollywood Lease Expiration Mr. Warren said MEA and AEA have not met to discuss the expiration of the lease and permit of the first 5.5 miles of line from Teeland to Douglas. He doesn’t anticipate an agreement before the October 1 expiration and asked to extend the lease agreement by 60 days. Mr. Borgeson asked Mr. Warren if AEA has made a determination regarding Section 9 of the Joint Use Agreement, specifically if AEA has determined that the line is no longer needed as an integral part of the intertie. Mr. Warren stated that AEA has not made the determination that the line is no longer needed as an integral part of the intertie. Section 9 states that when the electrical transmission line as a component part of the Intertie is no longer required, then AEA will transfer title to MEA at no cost. Mr. Warren and several members of the committee stated this line is still needed for transmission. MEA views Section 1 that states “the license and permit shall terminate upon the transfer described in Section 9 but in all events no later than Oct. 1, 2018” to mean regardless of events the transfer will take place Oct. 1, 2018. Mr. Izzo wants to talk with his legal counsel on their options to enforce the agreement. A motion was given to investigate the option to extend the lease by 60 days and encourage AEA and MEA to meet and work this out. The motion passed with MEA abstaining.
